So, the Republican strategy for 2024 is deep and incredibly sinister. But, you ask, what is it? How is it going to work?
This is what I believe they’re up to and why.
In a nutshell, the long-term plan is one-party control (them). They’re building it from the states up. What they’re trying to achieve is a permanent lock on the House and the Presidency by manipulating electoral votes at the state level.
The first two schemes are well underway.
Gerrymandering gives them an inflated number of electoral votes, regardless of popular majority because it constrains Democratic votes to fewer districts. Representatives are chosen by district, and, in most states, the presidential candidate winning the majority of districts gets the whole state’s electoral vote.
This is what Republicans are trying to stack up by gerrymandering.
The senate seats and governors are vulnerable to an entire state’s popular vote. The second scheme- voter suppression- warps this by limiting access to voting in blue districts. Even so, they don’t have a lock on it. The occasional blue senator or governor gets through.
The third scheme is the tricky one- fraud. As in 2020, the idea is still to claim fraud and get Dem votes overturned to make any Dem fall short of the 270 threshold, even if they still get more than Trump.
In 2020, Trump’s lawyers were unable to get any judges or governors to ‘play ball’- change the results to declare Trump the winner or Biden’s electoral votes invalid. Hence the whole ‘alternate electors’ scheme so miserably pulled on J6.
Now they know that won’t work. And they really know that officials with integrity are not going to suddenly play along, like Brad Raffensburger in Georgia and Rusty Bowers in Arizona, both of whom refused to break the law and overturn their state’s results for Trump.
So, as part of these same laws passed in red states to gerrymander districts and reduce registration and polling in urban (blue) districts, they have quietly changed the supervisor of elections authority wherever the incumbent office was a Democrat or a Republican who wouldn’t ‘play ball’.
They further added that this person has the authority to declare fraud and overturn or reject an election.
When they declare fraud on election night, again, it will be time for the ringers- those election authorities installed or invested since 2020 with power to overturn. If it all goes to plan, Trump-friendly officials will pull that trigger and, of course, be sued. Maybe even in a state where there’s a Trump-friendly judge. But as there would be an appeal in any case, they are counting on getting to the Supreme Court well before Jan. 6, 2025.
A likely scenario is a Harris suit demanding proof of fraud, and positing the unconstitutional nature of overturning a constitutional right over unproven suspicions. Trump’s defense will be that the official has the authority. She wins, Trump appeals, loses, then heads to the Supreme Court.
The Supreme Court will not be asked by Trump to decide if votes were legally overturned because fraud had, indeed, been committed. Instead, they will be asked to uphold or deny Trump’s defense- the particular official’s authority to void an election over suspicion of fraud. Just as ‘criminal’ acts were not referenced in the immunity case, even though that was the point, likewise, the lack of proof will not be cited as a reason to deny the authority.
We say the Supreme Court. We really mean the six Federalist Society-appointed conservative justices who have been overturning everything they touch and granting Trump every pass. We not-so-lovingly call them the FedSoc Six.
They’ve already ruled the immunity case by pretzel logic. It’s what will be expected of them by December 14th.
This has become a ’tell’ by Trump-friendly judges- using the re-phrasing of the question to allow an easily refutable argument to be seriously considered. Aileen Cannon has done it in the Florida documents case, and the FedSoc Six did it in their now-infamous immunity ruling.
The whole point of it all, of course, is the same as it was in 2020- to force a House vote for president because no one has reached 270. One vote per state, Republicans hold more states- Trump wins.
This time, they want to go into Jan. 6 with the electoral votes already decimated by the courts, so objecting will be a formality.
So, just as they came through for Trump with the immunity case, the FedSoc Six now must be expected to allow swing state votes where Harris wins to be thrown out by one person over unproven allegations of fraud because the state law says they can.
All of them will end up in court and all one has to do is get a judgement either way and it’s on the appeal train to the FedSoc Six.
As the the Six have proven, they don’t seem to care much about the actual cases themselves and tend to rule on the issue they want to endorse. Again, the immunity case was quite deliberately a question about liability for criminal actions in office, which were, until now, automatically assumed to be unofficial acts.
But, now, a president can call anything an ‘official act’ and -poof! It’s immune!!
Who knew?
This is the strategy we’re all up against. This is not coming from Trump- he’s nowhere near smart enough and knows more about Big Macs than he does about, um, anything. Except, maybe, KFC.
This plan is coming from the people in the Republican Party that are capable of this kind of conniving, among them the Heritage Foundation, the Federalist Society, and congressmen such as Speaker Mike Johnson, who, it happens, was the lead attorney for the ‘Alliance Defending Freedom (hehehe), the far right cross-chasing legal group. These are the people with the brains and lack of scruples needed to plan such elaborate political fraud.
The election itself will be as transparent and fraud-free as the last one actually was, as virtually all of our elections have been, and like 2020, and even more so, independent voters will likely come out for Harris, more new voters will come on for her (indeed, already are), and an even larger percentage of voters will turn out in general.
The wider, more ubiquitous the vote for Harris, the more likely a judge will uphold the election results and dismiss the fraud claims, just like they did in 2020. It’s also likely there will be just as much admissible evidence of fraud as 2020- none.
It’s hard to believe that Trump will have increased his voter base, let alone added the 15% he’d need to match Biden’s 2020 total, especially in light of his bizarre behavior and criminal charges. To reach his previous 74 million votes will be an accomplishment on its own.
But, Biden got 84 million, and with the energy already surrounding Kamala, she could hit 90 million.
So, winning the swing states by incredible margins, and turning some red states, like Florida, where youth voter registrations are spiking, are the key to setting consistent precedents that allow these lower court judges to dismiss the imaginary fraud suits like they did before.
And these regional federal courts is where this will play out. Republicans are counting heavily on getting a case to the FedSoc Six.
This is the only path forward for Trump. He cannot win fairly. And, it’s also unlikely they would rent him the Elipse again. So insurrection is likely out.
He can’t count on vilification against Kamala Harris. Efforts at painting her as criminal or deviant are going to fall flat with him still facing over 50 more felonies after being convicted of 34, and judged guilty or liable for sexual assault, defamation and tax fraud, and that’s all just since he left office.
And, we have to remind ourselves that we’re speaking about the accepted candidacy of a former president who’s still facing over 50 more felonies after being convicted of 34, and judged guilty or liable for sexual assault, defamation and tax fraud, and that’s all just since he left office.
Republicans know they are the minority. Their base is a minority of voters. Huge numbers of voters are independent. Many don’t vote at all.
Republicans’ ideas are really bad and unpopular and Trump is really weird and crooked, but they’ll still try to get around all that and let the FedSoc 6 just give it to him.
We will all be forced to endure some of the most ridiculous, outrageous, hilarious, ignorant and bizarrely conceived legal cases in judicial history.
They are “just not going to let Dems get away with stealing the election by getting more votes”.
As Joseph Stalin infamously said- “It's not who votes that counts, it's who counts the votes”.
Republicans can’t count on the voters, so they’re gonna start counting the votes.
So, that’s the likely plan.
Fraud, court, FedSoc Six, no 270, House elects Trump. Project 2025.
I know.
Let’s be careful out there.
